Other states had abortion bans prior to Roe’s decision, but failed to enforce them over the past five decades. Michigan has a pre-Roe restraining order that is currently the subject of court challenge.

A group of countries eventually intend to ban abortion very early in pregnancy, often before a woman knows she is pregnant. One such state is Georgia, where abortion will be banned after six weeks. Some states, such as Texas, have multiple bans.

In many cases, states’ constitutional court challenges are likely, and experts believe there will be chaos for days or weeks as states implement the bans.

Can The Federal Government Stop This?

The most effective defense against state abortion bans is federal law, which predates the states. Public opinion favors such a statute – 85% of Americans believe that abortion should be legal in most or all cases.

Such legislation would need the support of a majority of the House of Representatives, a majority of 60 votes in the Senate and the signature of Joe Biden to pass. A majority of House members support the abortion rights bill, as does the White House.

However, Republicans will almost certainly block abortion rights legislation in the Senate, which is split equally with Democrats. A Democratic senator, Joe Manchin of West Virginia, has repeatedly crossed party lines to vote against abortion rights. That number drops to 49 Democrats, lacking much of the support needed to pass such a measure.
